General Terms and Conditions of Business of the company LaimaDinner sarl for shop LaimaDinner ch.
These General Terms and Conditions of Business apply to the purchase of products in the E-Shop of the company LaimaDinner sÓrl and for all information or other services which are rendered for you in the E-Shop or by LaimaDinner sÓrl.
In order to make full use of LaimaDinner E-Shop, which also includes the placing of articles in the shopping cart and the payment procedure, you must ensure that your browser settings permit both cookies as well as pop-ups.
LaimaDinner E-Shop is operated by Swiss Post Postfinance , a company officially registered under Swiss law.
1. Ordering conditions
The contract comes into force with the placing of the order by the client and its electronic confirmation by LaimaDinner. Once the order has been confirmed by LaimaDinner, cancellation is possible only 10 days before delivery date.
i. All prices include statutory value added tax. Payment may be performed using a credit card issued by one of the following companies MasterCard and Visa, by PayPal ,Maestro and Postfinance credit card.
Payment by credit card will be settled by the company SIX Multipay SA. This may generate additional foreign interbank charges amounting to 1% to 2% of the order volume. Any such additional costs shall be charged directly to the customer.
i. All orders are subject to confirmation by LaimaDinner. The billing amount will be debited when the order is placed.
ii. By virtue of the presentation of our goods, you are invited to submit a purchase offer in the form of an order. If we accept your order, then as a rule you will receive an e-mail confirmation . We shall of course also inform you by e-mail if we are not able to accept your order.
i. Delivery address Delivery is restricted to the territory of Switzerland. ZIP codes to which LaimaDinner delivers can be checked on the website. All orders confirmed by LaimaDinner will be delivered to the delivery address given by the customer.
ii. Customer absence during delivery If the customer is not at home when the order is delivered, and in the absence of any further information, it will be delivered to his or her door. A delivery slip with time indicated will be placed in the mail box of the customer.The customer can choose to have the delivery left with a neighbor in the same building, if he or she enters the neighborĺs name, phone and address when placing the order. LaimaDinner undertakes to respect the cold chain until delivery of the goods to the customerĺs address. From the moment of delivery, the customer is the sole responsible for the goods, independently of his/her presence or absence upon delivery.
iii. Delivery schedule LaimaDinner will be carrying out deliveries by chosen slots either 14.00-17.00 or 17.00-20.00 either to the customers home or office.Deliveries to the offices have a special delivery time. LaimaDinner will make best reasonable effort to deliver within the requested time slot. Delivery may occur outside the indicated time slots, due to force majeure. In these cases, the customer has no claim for any compensation whatsoever. The selection of a specific delivery time within the slot is not possible. No deliveries will be made on official national or cantonal holidays.
iv. If the delivery area is not available, despite the acceptance of your order, then we shall be entitled to withdraw from the agreement. In this event we undertake to inform you without delay about the non-availability of the order; if your credit card, your PayPal account or your bank account has already been debited, then we shall reimburse the payment price without delay.
d. Order cancellation/Return of goods
The customer becomes responsible for delivered products, even if delivery has been made to an alternative delivery point. No returns are possible. Complaints regarding the quality of the delivery will be accepted within 5 days after receipt of the merchandise. LaimaDinner may ask for the damaged goods to be sent back for inspection. LaimaDinner will make individual compensation agreements with the customer in case of damaged/missing goods in the package. If the customer orders a product by mistake, the product will neither be taken back nor reimbursed by LaimaDinner.
ii. The customer may cancel the order no later than 10 days before delivery, without any charge. Cancellation after this date does not cancel payment obligation.
2. Warranty and liability of LaimaDinner sÓrl
a. Servicei. LaimaDinner is committed to bringing quality products to your door. Customer satisfaction is our priority and our goal is to provide you with outstanding service. If you are not satisfied with the order, we would like to be told immediately. We will make best reasonable effort to resolve issues to your satisfaction.
b. Productsi. LaimaDinner delivers products for family meals preparation and cooking instructions in two languages
ii. LaimaDinner believes the size and nutritional data of our products to be correct and accurate. Amount of fresh goods may vary slightly depending on the size of the product unit/package.
iii. LaimaDinner delivers fresh products and dried/canned goods packed by respective manufacturers.
iv. As with any edible product, the customer should check for any specific nutritional or dietary restrictions on the packages before consuming any item purchased from LaimaDinner.
v. Resale of products purchased at LaimaDinner is prohibited.
vi. If something from the ordered package is not available at the time of delivery, LaimaDinner will replace it with an appropriate other product and change the cooking instruction accordingly.
i. LaimaDinner will pass on personal customer data to a third party only to the extent that they are needed to execute the order or the payment (e. g. information transmitted to the Swiss Post, to a debt collection agency in case of non-payment, etc.), to inform our customers or to carry out surveys. All personal information is treated with absolute confidentiality.
ii. LaimaDinner reserves the right to use information on purchase patterns in anonymous form for commercial purposes.
iii. If you send ideas, remarks, questions, or similar to LaimaDinner E-Shop, then these shall become the exclusive property of LaimaDinner sarl. The contributions shall not be considered to be confidential, and we may use or publish these in any manner possible, without obligations or informing you. The contributions or any other type of information which you send to us should not constitute or contain any offensive, pornographic, defamatory, blasphemous or unlawful material that breaches any existing law, whether civil, criminal or religious. You confirm that all the material which you send to us is your property, and that you have not copied this wholly or in part from any third party. Please do not send us any material which is to be handled confidentially.
Applicable law and place of jurisdiction
All legal agreements are governed exclusively by Swiss law.
